DEFINITIONS
For the purpose of these Terms of Service, the following definitions will apply.
“Terms of Service” means these coaching and services and candidate terms and conditions.
“Client means any person or corporation that uses LatiNet Services.
“Client Information” means any information provided by a Client to LatiNet, or any information that the Client otherwise consents to be collected by LatiNet about the Client.
“Career Coaching Services” means career coaching services provided by LatiNet to a Client for the purpose of assisting a Client to obtain employment by an Employer
“Employer” means a third-party employer that has engaged LatiNet to arrange Introductions.
“Employment” means a permanent employment or casual employment arrangement between the Client and a third-party employer as the result of an Introduction.
“Price” or “Fees” means the fees payable by the Client in consideration of the LatiNet Services as notified by LatiNet in the Scope.
“GST” has the same meaning given to it in the Goods and Services Tax Act 1985 No 141 (as at 15 December 2022), Public Act – New Zealand Legislation.
“Introduction”, in relation to a Candidate, means where LatiNet supplies, orally or in writing, any information about a Candidate to the Client (such as the Candidate’s name, academic record, employment history or other relevant information); and “Introduced” has a corresponding meaning.
“Courses” means packages or any other online service purchased by the Client or User through our website or directly with one of LatiNet representatives.
“LatiNet” means LatiNet NZ Ltd, (NZBN 9429042352884 629 042 575)
“LatiNet Services” means any of the following services provided by LatiNet:
(a) Recruitment services, including arranging introductions and placements;
(b) Training or Coaching services;
(c) Packages or Courses;
(d) Career Coaching Services; and
(e) Use of the Website
“Privacy Laws” means the Privacy Act 2020 (NZ)
“Privacy Policy” means the privacy policy of LatiNet available at the Website
“Scope” means the scope of works provided to the Client by LatiNet by email.
“Tax Invoice” means the tax invoice for the Fee in accordance with this Agreement and the Scope provided by LatiNet to the Client
“User” means any Client or other users of the Website.
“Website” means https://latinet.co.nz/ or https://clublatinet.com/ or any other website operated by LatiNet from time to time to provide LatiNet Services.
TERMS AND CONDITIONS
Enrolment and Access
(a) Enrolment: To enroll in our Courses, you must provide accurate and complete information during the registration process. You must be at least 18 years of age or have the consent of a parent or guardian to enroll in our Courses.
(b) Access: Upon successful enrolment, you will be granted access to the Courses for the duration specified in the Course description. Access is personal and non-transferable. You may not share your account credentials or access to the Courses with any third party.
Course Content
(a) Curriculum Vitae (CV) Creation: Our Courses provide instruction on creating effective CVs, including guidance on formatting, content, and presentation.
(b) Job Interview Skills: Our Courses provide instruction on job interview skills, including techniques for answering common interview questions, presenting oneself professionally, and preparing for different types of job interviews.
(c) No Job Guarantee: While our Courses are designed to provide valuable skills and knowledge, we do not guarantee that you will secure a job as a result of enrolling in our Courses. Job prospects may vary based on individual effort, experience, and market conditions.
Payment and Refunds
(a) Payment: You agree to pay the fees specified on our Website for enrolling in our Courses. Payment must be made in full at the time of enrolment and can be made using the available payment methods on our Website.
(b) No Refunds: All Course fees are non-refundable. We do not provide refunds for any reason, including but not limited to a change of mind, dissatisfaction with Course content, or inability to complete the Course. Please review our Course descriptions and policies carefully before enrolling.
Intellectual Property
(a) Ownership: All intellectual property rights in our Courses, including but not limited to course materials, videos, audio recordings, worksheets, and any other content provided, are owned by us or our licensors.
(b) Restrictions: You may not reproduce, distribute, share, modify, adapt, create derivative works of, publicly display, or otherwise use our Course content without our prior written consent.
User Conduct
(a) Prohibited Activities: You agree not to use our Website or participate in our Courses for any unlawful, fraudulent, or unauthorized purpose. (c.) No Money Devolution: You acknowledge and agree that all Course fees are non-refundable, and we do not provide any money devolution for any reason, including but not limited to dissatisfaction with Course content, inability to complete the Course or failure to secure a job.
Indemnity
You agree to indemnify, defend, and hold harmless our company, its affiliates, instructors, and employees from and against any claims, damages, losses, liabilities, and expenses arising out of or in connection with your use of our Website or participation in our Courses, including but not limited to any breach of these Terms, your violation of any law or third-party rights, or your misuse of our Course content.
Modifications and Termination
